These Terms of Service (the "Terms") govern your access to and use of Capium Browser and this website (together, the "Service"), operated by Capzy LLC ("Capzy", "we", "us"). By creating an account, installing the software, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Capium Browser is a licensed software product that runs on your own machine. Your license key unlocks the software and entitles you to updates for the duration of an active subscription. Accounts, billing, and license management are handled on capzy.ai.
2. License
Subject to these Terms and your active subscription, Capzy grants you a limited, non-exclusive, non-transferable, revocable license to install and use the software for your internal business or personal purposes, up to the concurrency limits of your plan. You may not sublicense, resell, rent, or redistribute the software or your license key.
You may not copy, modify, reverse engineer, decompile, or attempt to derive the source code of the software except to the extent that restriction is prohibited by applicable law.
3. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy. You are solely responsible for how you use the software, for the targets you access, and for complying with all applicable laws and the terms of the websites and services you interact with.
4. Subscriptions and billing
Paid plans are billed in advance on a recurring basis through your account on capzy.ai. Fees are non-refundable except where required by law or expressly stated at the point of sale. We may change plan pricing on a prospective basis with reasonable notice. You can cancel at any time; cancellation takes effect at the end of the current billing period.
5. Accounts
You are responsible for safeguarding your account credentials and license key and for all activity under your account. Notify us promptly of any unauthorized use.
6. Intellectual property
The Service, including the software, this website, and all related trademarks and content, is owned by Capzy LLC and protected by intellectual property laws. These Terms grant you no rights other than the license expressly described above.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or achieve any particular result against any third-party system.
8. Limitation of liability
To the maximum extent permitted by law, Capzy LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms or the Acceptable Use Policy, or to comply with law. On termination, your license ends and you must stop using the software.
10. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Virginia.
11. Changes
We may update these Terms from time to time. Material changes will be reflected by the "last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
